Si vous n&#8217;acceptez pas ces conditions, veuillez ne pas utiliser nos Services.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Definitions<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cShipment\u201d means any parcel, package, document or item accepted by Performance Courrier for collection and delivery.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cClient\u201d means any natural or legal person who places an order or has an account with Performance Courrier.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cRecipient\u201d means the natural or legal person designated by the Client to receive a Shipment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cService area\u201d refers to the geographical areas in which Performance Courrier operates, as published on our website.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00ab Preuve de livraison \u00bb d\u00e9signe le document \u00e9lectronique ou \u00e9crit confirmant la livraison de l&#8217;envoi, incluant l&#8217;heure de livraison et la signature du destinataire, le cas \u00e9ch\u00e9ant.<\/p>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li><strong>Services<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2.1 Scope of services<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2.2 Service Availability<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Performance Courrier offers same-day courier and delivery services in its service area, including: local and regional deliveries in Montreal and Quebec City, express and scheduled deliveries, medical and pharmaceutical courier services, as well as specialized handling for clients in the legal, financial and aeronautical (AOG) sectors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Services are provided subject to availability within our service area. Performance Courier reserves the right to refuse any order at its discretion, including orders containing prohibited items, orders destined for locations outside our service area, or orders presenting security or legal risks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2.3 Online Booking<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Les clients peuvent passer une commande par l&#8217;interm\u00e9diaire de notre portail de r\u00e9servation en ligne, par t\u00e9l\u00e9phone ou par l&#8217;interm\u00e9diaire de leur compte client. En soumettant une commande, vous confirmez que tous les renseignements fournis sont exacts et complets et que vous \u00eates autoris\u00e9 \u00e0 exp\u00e9dier les articles d\u00e9crits.<\/p>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li><strong>Customer Responsibilities<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3.1 Accuracy of information<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is the Client's responsibility to provide accurate pickup and delivery addresses, contact information, a precise description of the package, and any special handling instructions. Performance Courrier accepts no liability for delays or non-delivery due to inaccurate or incomplete information.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3.2 Packaging<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Il incombe au client de s&#8217;assurer que tous les envois sont correctement emball\u00e9s, scell\u00e9s et \u00e9tiquet\u00e9s avant l&#8217;enl\u00e8vement. Performance Courrier d\u00e9cline toute responsabilit\u00e9 en cas de dommages r\u00e9sultant d&#8217;un emballage inad\u00e9quat.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3.3 Prohibited items<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer must not ship the following prohibited items:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Illegal substances, narcotics or controlled substances (except with express authorization for clients in the medical or pharmaceutical sector)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Firearms, weapons or ammunition;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dangerous materials, flammable or explosive substances (unless prior authorization and a proper declaration have been made)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Live animals<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Money, negotiable instruments or precious metals without prior written authorization<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Perishable goods without prior notice and proper packaging<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Items requiring temperature control without prior agreement<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Performance Courier reserves the right to open and inspect any shipment suspected of containing prohibited items, and to refuse or return such shipments at the Client's expense.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3.4 Compliance with laws<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is the Client's responsibility to ensure that all shipments comply with applicable federal, state, and local laws and regulations, including customs and transportation regulations.<\/p>\n\n\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li><strong>Pricing, invoicing and payment<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4.1 Prices<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Service rates are calculated based on distance, delivery type, weight, and any special handling requirements. Applicable rates will be displayed at the time of booking or included in the customer's account agreement. Performance Courrier reserves the right to change its rates with reasonable notice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4.2 Billing<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Invoices are issued in accordance with the customer's account agreement (usually weekly or monthly for account holders, or immediately for one-off orders). All amounts are in euros unless otherwise stated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4.3 Payment terms<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le paiement est d\u00fb dans les 30 jours suivant la date de facturation, sauf accord \u00e9crit contraire. Performance Courrier se r\u00e9serve le droit d&#8217;appliquer des int\u00e9r\u00eats de retard au taux de 1,5 % par mois (18 % par an) et de suspendre les services pour les comptes \u00e0 solde impay\u00e9.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4.4 Disputing invoices<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Si vous estimez qu&#8217;une facture comporte une erreur, vous devez nous en aviser par \u00e9crit dans les 15 jours suivant la date de facturation. Les sommes non contest\u00e9es demeurent dues et exigibles.<\/p>\n\n\n\n<ol start=\"5\" class=\"wp-block-list\">\n<li><strong>Delivery and tracking<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>5.1 Delivery times<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Estimated delivery times are provided for informational purposes only and are not guaranteed unless expressly stated in writing. Performance Courier will make every effort to deliver shipments within the stated timeframe, but cannot be held liable for delays caused by circumstances beyond its control (see Article 9 \u2013 Force Majeure).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>5.2 Proof of Delivery<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00c0 la livraison, une preuve de livraison (PD) sera \u00e9tablie, indiquant l&#8217;heure de livraison et le nom du destinataire. Des frais suppl\u00e9mentaires peuvent s&#8217;appliquer pour les tentatives de nouvelle livraison.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>5.4 Shipment tracking<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Customers with an online account can track their shipments in real time via the customer portal. Tracking data is provided for informational purposes only and does not constitute a delivery guarantee.<\/p>\n\n\n\n<ol start=\"6\" class=\"wp-block-list\">\n<li><strong>Liability and claims<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>6.1 Limitation of Liability<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La responsabilit\u00e9 de Performance Courrier en cas de perte, d&#8217;endommagement ou de retard d&#8217;un envoi est limit\u00e9e au moindre des montants suivants&nbsp;: (a) la valeur r\u00e9elle prouv\u00e9e de l&#8217;envoi, ou (b) 100,00&nbsp;$ CA par envoi, sauf si une assurance valeur d\u00e9clar\u00e9e suppl\u00e9mentaire a \u00e9t\u00e9 souscrite \u00e0 l&#8217;avance et les frais applicables acquitt\u00e9s.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>6.2 Declared Value Insurance<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Les clients peuvent d\u00e9clarer une valeur plus \u00e9lev\u00e9e pour un envoi au moment de la r\u00e9servation. Performance Courrier n&#8217;est pas un assureur. Les clients exp\u00e9diant des marchandises de grande valeur sont invit\u00e9s \u00e0 souscrire une assurance transport appropri\u00e9e.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>6.3 Exclusions<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Performance Courrier declines all responsibility for:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Les pertes ou dommages r\u00e9sultant d&#8217;un emballage inad\u00e9quat du client<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Losses or damages related to prohibited or undeclared items;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consequential, indirect or punitive damages;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Les retards caus\u00e9s par la circulation, les conditions m\u00e9t\u00e9orologiques, les fermetures de routes ou d&#8217;autres circonstances ind\u00e9pendantes de notre volont\u00e9<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Loss or damage related to fragile, perishable or temperature-sensitive items not declared at the time of booking<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Acts of third parties, including refusal of delivery by the recipient;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>6.4 Complaints Procedure<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All claims for loss or damage must be submitted in writing to <a href=\"mailto:info@performancecourrier.com\">info@performancecourrier.com<\/a> within 15 days of the scheduled delivery date. Claims made after this period will not be accepted. Performance Courrier will acknowledge receipt of claims within 5 business days and will render its decision within 30 days.<\/p>\n\n\n\n<ol start=\"7\" class=\"wp-block-list\">\n<li><strong>Conditions d&#8217;utilisation du compte<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>7.1 Account Opening<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L&#8217;ouverture d&#8217;un compte d&#8217;affaires est assujettie \u00e0 l&#8217;approbation du cr\u00e9dit. Performance Courrier d\u00e9cline toute responsabilit\u00e9 pour les pertes r\u00e9sultant d&#8217;une utilisation non autoris\u00e9e du compte avant notification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>7.3 Account Suspension and Termination<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Performance Courrier peut suspendre ou r\u00e9silier un compte client en cas de non-paiement, de violation des pr\u00e9sentes conditions, d&#8217;abus envers notre personnel ou nos chauffeurs, d&#8217;envoi d&#8217;articles interdits ou de tout comportement pr\u00e9sentant un risque pour nos op\u00e9rations ou notre personnel. La r\u00e9siliation n&#8217;exon\u00e8re pas le client de ses obligations de paiement.<\/p>\n\n\n\n<ol start=\"8\" class=\"wp-block-list\">\n<li><strong>Medical and specialized services;<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Performance Courrier offre des services de messagerie m\u00e9dicale certifi\u00e9s pour les h\u00f4pitaux, les laboratoires et les entreprises pharmaceutiques. Les clients qui utilisent ces services s&#8217;engagent \u00e0&nbsp;:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Properly label all shipments of biological, medical or pharmaceutical products in accordance with applicable regulations (including Transport Canada and Health Canada requirements)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Provide all required documentation, manifests, and chain of custody evidence<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Do not ship controlled substances without the proper permit and prior written authorization from Performance Courier.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La certification m\u00e9dicale de Performance Courrier s&#8217;applique uniquement \u00e0 la manutention et au transport. Le client demeure seul responsable de la conformit\u00e9 r\u00e9glementaire concernant le contenu des envois m\u00e9dicaux.<\/p>\n\n\n\n<ol start=\"9\" class=\"wp-block-list\">\n<li><strong>Force majeure<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Performance Courrier ne peut \u00eatre tenu responsable de tout manquement ou retard dans l&#8217;ex\u00e9cution de ses obligations en vertu des pr\u00e9sentes conditions g\u00e9n\u00e9rales dans la mesure o\u00f9 ce manquement ou ce retard est d\u00fb \u00e0 des circonstances ind\u00e9pendantes de sa volont\u00e9, notamment&nbsp;: cas de force majeure, \u00e9v\u00e9nements extr\u00eamesweather, road closures, traffic accidents, labour disputes, government actions, pandemics, or failures of third-party infrastructure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the event of force majeure, Performance Courrier will inform the customers concerned as soon as possible and will resume its services as soon as possible.<\/p>\n\n\n\n<ol start=\"10\" class=\"wp-block-list\">\n<li><strong>Intellectual property<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">All content on the Performance Courrier website, including text, logos, images, and software, is the property of Performance Courrier Inc. or its licensors and is protected by applicable intellectual property laws. Any reproduction, distribution, or modification of the content is prohibited without our prior written consent.<\/p>\n\n\n\n<ol start=\"11\" class=\"wp-block-list\">\n<li><strong>Confidentiality<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms and Conditions by reference.
